What is Berry Compliance?
In short, Congress originally passed the Berry Amendment Clause in 1941, which was created to promote the purchase of American-Made goods and products. Being Berry Amendment Compliant is a requirement that was mandated into law in 1994 (section 8005 of Public Law 103-139), making it unlawful for the U.S. Department of Defense (DoD) to purchase specific materials from non-US Manufacturers.
If your project is affiliated with the U.S. Department of Defense (DoD), then you have two options: if your funding is connected to the DoD will need to be Berry Compliant. Being Berry Amendment Compliant is a requirement that was mandated into law in 1994 (section 8005 of Public Law 103-139), making it unlawful for the U.S. Department of Defense (DoD) to purchase specific materials from non-US Manufacturers.
